ELECTRONIC CTP IN THE RUSSIAN FEDERATION

Initially, the idea of an electronic insurance contract was discussed back in 2014. The reason for this idea was the crisis in the field of auto insurance, when the amount of insurance increased to 500,000 rubles, and for each potential beneficiary (victim), while insurance premiums remained at the same level, which subsequently caused huge damage to the profitability and solvency of most insurance companies. Insurers saw one way out of this situation: the introduction of additional insurance conditions, the provision of additional insurance services or the conclusion of additional insurance contracts (for example, life and health insurance). To get out of this situation, the legislator proposed an alternative: electronic CTP - a program that does not allow the introduction of additional services or insurance contracts. Thus, the state tried to satisfy both public and individual interests at the same time. In this case, the public interest is manifested in the reassessment of its needs by the society, which determines the strategic direction of its further development

The electronic CTP policy plays an important role for car owners today, one of the main advantages for car owners is that the driver can completely independently issue an electronic CTP policy on the website of the selected insurance company. Thus, the question of the role of insurance intermediaries in modern insurance has become theoretically and practically relevant. In particular, insurance agents, whose activities were essentially limited to the execution of insurance contracts, were subjected to a serious "blow". By concluding an electronic CTP contract, the policyholder can independently draw up his future policy without resorting to the services of an intermediary.

Until recently, car owners could conclude a compulsory car insurance contract only with a personal visit to the insurer's branch. The algorithm for filling out the form for obtaining electronic CTP is quite simple and takes no more than 20 minutes. Each policy sold is liable for damage caused by the operation of the vehicle, and information about this is stored in the unified database of the Union of Automobile Insurance Companies of Russia. Previously, in order to add an additional driver to the usual CTP policy, you had to personally contact the insurance company with the entire package of documents. The change of the electronic policy will take place in the same personal account on the insurance company's website in a matter of minutes without leaving.

The undoubted advantage is that the electronic document does not deteriorate and is not lost, since its copy is stored in the database of the insurance company and the Russian Union of Motor Insurers. In addition, the electronic CTP system ensures that the insurance policy purchased online by the driver himself is real and valid.

When making CTP in paper form in the offices of insurance companies, car owners risk meeting with unscrupulous insurance agents, in electronic CTP such a situation may not happen. During the payment, the CTP electronic number is automatically entered into a single database, which excludes this type of fraud.

On October 29, 2019, the final part of the amendments to the CTP Law came into force. It is established that in case of conclusion of the CTP contract in electronic form, the driver, at the request of police officers (other bodies authorized to monitor the fulfillment of the obligation to conclude the CTP contract), can presentnot only a copy of the policy on paper, but also the policy in the form of an electronic document. In addition, as the Russian Union of Motor Insurers explained, the electronic policy now does not need to be printed on strict reporting forms.

Similar changes were made to the Rules of the Road by Decree of the Government of the Russian Federation No. 1747 dated December 21, 2019 "On Amendments to the Rules of the Road of the Russian Federation", namely, the Rules were supplemented with a new paragraph that provides that the insurance policy can be submitted in paper form, and in the case of a CTP contract in electronic form - in the form of an electronic document or a copy of it on paper. It should be noted that in any case, car owners are required to have a civil liability policy with them, and it does not matter whether it is a printout, an electronic version on a tablet or smartphone, or paper.

In this situation, the disadvantage may be that the driver has only an electronic policy, then checking the fact of concluding a compulsory insurance contract carried out by an employee of the State Transport Inspectorate by requesting information about it in the automated information system of compulsory insurance, may require a certain period of time.

Among the difficulties policyholders may face, it should be noted that the responsibility for reliably filling in the data lies with the owner of the car, or if an error occurs, while the data entered into the policy form, verification, as well as the funds spent on the purchase will not be refunded. In addition, incorrect filling in of information may lead to a delay in payment of compensation or even refusal to pay to the insurer. However, negative consequences can be avoided by observing due diligence and attentiveness.

Thus, we can say that electronic CTP in legal form is the same document as a paper car insurance contract. Today, motor liability insurance in electronic format is a convenient and simple way of insurance. Electronic policies were not created to completely replace the paper version of the document, but the extensive nature of their use suggests that over time electronic insurance becomes so popular that the paper equivalent simply loses its relevance.
